Remuneration for private copying

Remuneration for private copying was introduced to compensate performers, authors, and producers for the growing expansion of sound and audiovisual copying of works by individuals using blank media (smartphones, tablets, CDs, DVDs, etc.).

The law allows users to copy recordings for their own private use without having to seek permission from artists, producers, or authors. In return, a fee is charged, known as a “remuneration for private copying”, which is included in the purchase price of blank recording media.

This remuneration is collected by COPIE FRANCE from manufacturers or importers of storage media, which redistributes it particularly to Spedidam on behalf of its rightholders.

Half of the remuneration for private sound copying goes to authors and half to holders of so-called related/neighbouring rights, who share it equally, i.e. one quarter to performers and one quarter to producers. One third of the remuneration for private audiovisual copying goes to authors and two thirds to holders of related rights, who share it equally, i.e. one third to performers and one third to producers.

Remuneration payable to the “performers” category, as represented by Spedidam and Adami, is allocated as follows:

  • Private sound copying: 50% Spedidam, 50% Adami
  • Private audiovisual copying: 20% Spedidam, 80% Adami

Distributions are made based on the results of surveys.
