Artificial Intelligence: Spedidam is exercising the opt-out right on behalf of performers
Spedidam formally reserves the rights of its rightsholders for the use of their performances to train artificial intelligence (AI) models (opt out).
This reservation falls within the scope of the text and data mining exception provided for in Article 4 of Directive (EU) 2019/790 and transposed into French law in Articles L. 122-5-3 and L. 211-3 (8) of the Intellectual Property Code.
It is exercised regardless of the type of AI considered and covers all recordings of performers having statutorily assigned their rights to Spedidam or expressly mandated Spedidam to exercise their rights.
From now on, data mining of these performers’ sound and audiovisual recordings shall be subject to prior authorisation and appropriate remuneration.
At the same time, Spedidam is pursuing its efforts with the French and European public authorities to support all measures of transparency, remuneration and ethics that would safeguard the rights and livelihood of the performers that Spedidam represents.
