Exclusive rights 

Thanks to their exclusive rights, an artist’s performance cannot be fixed without their authorisation, nor can it be used for purposes other than those initially authorised, i.e. for secondary uses. 

By signing a Spedidam recording session sheet, the performer authorises the producer to record and/or use the recording of their performance in accordance with a clearly defined initial purpose. 

Any other uses must be subject to a request for authorisation and the payment of additional remuneration via Spedidam, which has been granted exclusive rights by the artist. 

Performers may therefore control secondary uses of their recordings. 

Please note that in the case of a soundtrack recording specifically designed for a live show, the authorisation granted to the producer by signing a recording session sheet applies only to the making of the recording, not to its communication to the public during performances of the show. 

By exercising their exclusive rights in collective management through Spedidam, performers may receive from Spedidam the remuneration that it has collected by issuing authorisations on their behalf for secondary uses of their initial recording.
